1. Introduction

These Terms and Conditions ("Terms") govern the purchase, use, and redemption of Portugal Getaways Non-Expiring Digital Gift Cards ("Gift Cards"). By purchasing or using a Gift Card, you agree to be bound by these Terms.

2. Issuer

The Gift Cards are issued by Portugal Getaways ("Company," "we," "us," or "our"), a company incorporated under the laws of Portugal, with its principal place of business in Ponta Delgada, Azores.

3. Purchase and Redemption

Purchase

Gift Cards can be purchased online through our website. Gift Cards are available in denominations of $50, $100, $150.

Redemption

Gift Cards are redeemable only for the purchase of eligible travel packages offered by Portugal Getaways. Gift Cards cannot be used to purchase other gift cards.

How to Redeem

To redeem a Gift Card, enter the unique code provided via email at the time of checkout on our website.

4. No Expiration or Fees

No Expiration Date

Gift Cards do not expire and remain valid until the total value has been redeemed.

No Fees

No inactivity or service fees apply to the Gift Cards.

5. Restrictions

Non-Transferable

Gift Cards are non-transferable and cannot be resold, exchanged, or redeemed for cash, except as required by law.

Single Use

Gift Cards are intended for personal use. Commercial use, including promotional or marketing activities without our express written consent, is prohibited.

Limitations

Gift Cards cannot be applied to any past purchases or used to pay for subscriptions or installment plans.

6. Balance Inquiry

Checking Balance

You can check your Gift Card balance by logging into your account on our website or by contacting our customer service.

7. Refunds and Cash Redemption

General Policy

Gift Cards are non-refundable and cannot be redeemed for cash, except where required by law.

Cash Redemption Requirements

United States:
In certain states, you are entitled to redeem your Gift Card for cash if the remaining balance is below a specified amount:

• California: $10 or less
• Colorado: $5 or less
• Maine: Less than $5
• Massachusetts: $5 or less
• New Jersey: Less than $5
• Oregon: $5 or less
• Rhode Island: Less than $1
• Texas: Less than $2.50
• Vermont: Less than $1
• Washington: $5 or less

Canada:
In Ontario, you can request cash redemption if the remaining balance is $10 CAD or less.

How to Request Cash Redemption

To request a cash redemption where applicable, please contact our customer service with your Gift Card details.

8. Lost or Stolen Gift Cards

Responsibility

Treat your Gift Card like cash. We are not responsible for lost, stolen, or unauthorized use of Gift Cards.

Replacement

Lost or stolen Gift Cards will not be replaced unless required by law.

9. Fraud Prevention

Right to Cancel

We reserve the right to void Gift Cards or suspend or terminate customer accounts if we suspect fraudulent, unlawful, or otherwise improper use.

Verification

We may request additional verification or information before processing a Gift Card purchase or redemption.

10. Data Privacy

Personal Information

By purchasing or using a Gift Card, you consent to the collection, use, and disclosure of your personal information in accordance with our Privacy Policy, available here.

Data Protection

We comply with applicable data protection laws, including the California Consumer Privacy Act (CCPA) and the Personal Information Protection and Electronic Documents Act (PIPEDA) in Canada.

11. Intellectual Property

Ownership

All trademarks, service marks, and trade names associated with Portugal Getaways are proprietary to us.

Limited License

Use of our trademarks is strictly limited to the use of Gift Cards in accordance with these Terms.

12. Limitation of Liability

No Warranty

Gift Cards are provided "as is" without warranties, express or implied.

Limitation

To the fullest extent permitted by law, we shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use a Gift Card.

13. Governing Law

United States Residents

These Terms are governed by Portuguese law, without regard to its conflict of law principles.

Canadian Residents

These Terms are governed by Portuguese law, and the federal laws of Canada applicable therein.

14. Dispute Resolution

Arbitration Clause

Any disputes arising out of or relating to these Terms or the Gift Cards shall be resolved through binding arbitration in accordance with the rules of Ponta Delgada Court, to be conducted in Portugal.

Exception

This arbitration agreement does not apply where prohibited by law.

15. Changes to Terms and Conditions

Amendments

We reserve the right to change these Terms at any time. Changes will be posted on our website with the "Last Updated" date.

Acceptance of Changes

Your continued use of the Gift Card constitutes acceptance of any amended Terms.

18. Special Gift Cards

Gift Cards with codes starting with "LOYL" ("Special Gift Cards") are subject to additional restrictions:

1. Single Use Per Booking: Only one Special Gift Card can be applied to a single booking or reservation.
2. Non-Cash Value: Special Gift Cards cannot be converted into cash or used to obtain cash.

By using a Special Gift Card, you acknowledge and accept these additional restrictions.
